Employment Law - Which Way to goEqual Treatment on the Horizon: Agency Workers Regulations are here


From 1st October, the Agency Workers Regulations (AWR) 2010 give agency workers the same basic employment conditions (after a 12 week qualifying period) in a given job as if they had been employed directly by the hirer.  


This includes key elements of pay, duration of working time, night work, rest periods and breaks, annual leave and paid time off for ante-natal appointments.   The Regulations also include new entitlements for agency workers from day one of their assignment with regards to access to facilities at the workplace and the right to be notified of any relevant vacancies.

National Minimum Wage (NMW): Increases in rates from 1st October 2011


The main rate of the national minimum wage rises from £5.93 to £6.08 per hour.   The development rate increases from £4.92 to £4.98 per hour, and the rate for workers aged 16 to 17 rises from £3.64 to £3.68 per hour.  The apprentice rate also increases from £2.50 to £2.60 per hour.     


Parental Leave Increase: Increases from three to four months


The minimum parental leave following the birth or adoption of a child increases from three to four months with at least one of those months not being transferable between parents. This legislation must come into force by 8th October 2012.
